TURKEY - Increasing competition in e-commerce has made it important for e-commerce companies and individual sellers to use all communication channels to reach buyers actively. However, e-commerce companies were subject to certain rules regarding sending commercial messages within the scope of Law No. 6563. On the other hand, according to Statista data, e-commerce companies using the Shopify e-commerce infrastructure and global e-mail providers, which operate with a market share of more than 10% worldwide, must submit message permissions to the Message Management System (IYS) within the specified 3-day legal period. They faced the problem of sending messages without permission because they could not transfer them systematically. Commercial messages sent by e-commerce companies were subject to certain rules within the Regulation on Commercial Communication and Commercial Electronic Messages issued by the Ministry of Commerce within the scope of Law No. 6563 on the Regulation of Electronic Commerce. In this context, it was stated that messages cannot be sent without the recipient's consent, that the recipient should be allowed to reject messages sent with permission, and that message permissions not declared to the system within 3 business days will be considered invalid. On the other hand, 2022 data showed that more than 791 thousand complaints made by citizens through the Commercial Electronic Message Complaint System (TİSS) imposed more than 371 million TL administrative fines on e-commerce companies.
