The economic course began to affect legal processes as well. ILKE Foundation, which aims to provide a broad perspective by analysing legal development in Turkey, the functioning of the judicial system and the performance of institutions with judicial statistics, has published the Legal Monitoring Report. The report drew attention to the negative manifestation of the economic uncertainties in judicial processes.

TURKEY - While many sectors have been affected by this situation in the recent period of ongoing global economic fluctuations, all eyes have turned to legal processes. ILKE Foundation published the Law Monitoring Report prepared by the Center for Social Thought and Research (TODAM) within the scope of the Filed Monitoring Reports Project. It revealed the balance sheet of law in 2022, which it evaluated within the interdisciplinary approach, especially sociology and economics. The Foundation’s report discussed issues such as the relationship between law and economy, the impact of economic changes in tax law on the digital economy, the impact of economic changes on tax law, the digital economy and data security, and banking and financial institutions. 

Stating that law cannot be defined by reducing it only to the judicial process, Law Monitoring Report Editor Atty Ahmet Sait Öner made the following statement, “Law is an area that has always found a place on the country’s agenda, concerns all segments of society, and whose impact is felt in every dimension of life. Therefore, law cannot be defined by reducing it only to the judicial process. It also relates to economic, psychological, and sociological processes and dynamics. Therefore, we prepared the report with an interdisciplinary approach, considering the law holistically. “We analysed many issues in a data-based manner, such as the Ministry of Justice, the judicial system, public institutions, bar associations, legal education, the directorate of Immigration Management, Trukey’s image in the European Court of Human Rights (ECHR) and its international comparison.”

Economic uncertainty harms legal security 

In the Legal Monitoring Report prepared by the ILKE Foundation, it is pointed out that economic uncertainties harm legal security, and it is stated that economic uncertainties harm legal security, and it is stated that the economic order affects the legal order and reduces the predictability in this field. In this context, it is emphasised that economic normalisation will guarantee the legal order. The negative consequences of high inflation on law are a prominent example of this situation. According to the report, the 25% upper limit set for the increase in housing rents due to high inflation causes a significant increase in workload in the civil courts of peace. As the problem deepens further in 2023, it disrupts the judicial functioning.

The Legal Monitoring Report of ILKE Foundation states that crimes against property will rank first in Criminal Court files in 2022. It is stated that this situation is remarkable in terms of the relationship between law and economy. It is also underlined that the administrative fines imposed by the Competition Board have increased in recent years. It is stated that this situation is due to the increase in the number of files and investigations regarding the food supply chain due to the inflationary period we are in.
